Second Nature Customer Referral Program: Terms and Conditions

Prospective customers referred to Second Nature Brands, Inc. (“Second Nature”) must be referred to Second Nature by a current Second Nature customer and must attend an RBP Demo Meeting within 60 days to qualify. Upon the completion of the RBP Demo Meeting by the prospective customer within 60 days, both the referrer and referee will receive a $100 Amazon Gift Card to the registered email address. Neither referrer or referee will be eligible for receipt of gift cards if RBP Demo Meeting occurs after 60 days or does not occur at all. Referrers must be current Second Nature customers to participate. Prospective customers are not obligated to become Second Nature customers to receive the gift card. Customers, prospective or existing, that accumulate $600 or more within a calendar year will receive a W-9 tax form that must be timely completed and returned to Second Nature. Failure to fill out the referral form correctly, or complete the W-9 if required, shall void the gift card offer. 

Terms, conditions, features, availability, pricing, fees, service, and support options of this program are subject to change without notice.

Second Nature reserves the right at any time and for any reason to modify these terms, or to change, interrupt or stop the program either for a period of time or permanently with or without notice. Second Nature reserves the right to delay, cancel, revoke, or prevent payment of rewards in any suspected case of fraudulent use or misuse of Second Nature services or this program. Referrals and rewards are subject to verification at Second Nature’s sole discretion.

DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT: (A) THE PROGRAM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND SECOND NATURE EXPRESSLY DISCLAIMS ALL WARRANTIES, CONDITIONS AND TERMS OF ANY KIND, WHETHER EXPRESS OR IMPLIED BY STATUTE, COMMON LAW OR CUSTOM, INCLUDING, BUT NOT LIMITED TO, WARRANTIES AS TO PRODUCTS OR SERVICES OFFERED THROUGH THE USE OF THE PROGRAM, IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; (B) SECOND NATURE DISCLAIMS ANY WARRANTY THAT (i) THE PROGRAM WILL MEET YOUR REQUIREMENTS, (ii) THE PROGRAM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, AND (iii) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE PROGRAM WILL MEET YOUR EXPECTATIONS; AND (C) ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE PROGRAM IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR MOBILE DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OR USE OF ANY SUCH MATERIAL.

LIMITATION OF LIABILITY AND INDEMNIFICATION

YOU UNDERSTAND AND AGREE THAT SECOND NATURE SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES. SECOND NATURE SHALL NOT BE LIABLE FOR ANY TECHNICAL ERRORS OR MALFUNCTIONS, DATA THEFT OR CORRUPTION, ANY PRINTING OR TYPOGRAPHICAL ERROR, OR ANY DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM PARTICIPATING IN, OR ACCESSING OR DOWNLOADING INFORMATION IN CONNECTION WITH THE PROGRAM. TO THE FULLEST EXTENT POSSIBLE BY LAW, OUR MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE PROGRAM, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY, OR OTHERWISE), WILL NOT EXCEED $100.

Applicable Law. Any and all disputes, claims, and causes of action arising out of or related to the Program or any prize awarded shall be resolved under Delaware law (without reference to its conflicts of laws principles), and participants in the program agree to submit any dispute to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware.
